8(a) Small Business
 

The U.S. Small Business Administration's (SBA) program enhances the capability of 8(a) participants to compete more successfully for federal government contracts. The program encourages private-sector relationships and expands SBA's efforts to identify and respond to the developmental needs of 8(a) clients. The program provides an avenue for disadvantaged Americans to achieve entrepreneurial success and contribute to the strength and vigor of our economy.

Tribal 8(a) Benefits
  • Federal contracts may be secured by Tribal firms without competition (OMB Circular A-76).
  • Sole source / single source awards to Tribal firms have no limit on contract values (FAR 19.805- 1 and 13 CFR 124.506).
  • Direct awarded contracts to Tribal firms cannot be protested (13 CFR 124.517).
  • A 5% bonus (based on the subcontract value) can be awarded to prime contractors for using Tribal firms (DFARs 226.1 or FAR 26.102).
  • The size of an Indian-owned enterprise, for small business eligibility purposes, is determined without consideration of the economic size of its parent (13 CFR 124.109).
