not only 8(a) qualified, but also is certified as a HUBZone
company, which allows it to qualify for other contracts
not even set-aside for 8(a) companies. HUBZone status
is in many ways more selective than 8(a) status and tribes
have an inherent advantage in maintaining HUBZone status,
which can have perpetual duration. In the Company’s
case, its domicile in Box Elder County (as well as its
trust land) can provide ongoing HUBZone status, which
combined with the 8(a) status make an attractive combination
for government contracting.

The Company maintains a Top
Secret Facility status, and its key personnel have Top
Secret clearances. This status allows the Company to perform
a number of projects, including current work for intelligence
agencies, Department of Defense and Homeland Security
contracting, etc. classified work at the appropriate level.
It also allows the Company to quickly and efficiently
process employee clearances.
In the area of Department
of Defense (“DOD”) contracting, for example,
DOD has mandated that 5% of DOD contracts are to be tribal
contracts. Indian Country has barely been able to make
1% of the DOD goal.
